Arbitration Decisions

Arbitration was addressed in the New Jersey case of K.V.H. v. W.S.H., reminding us that after Arbitration, there may be a limited right to appeal. After the parties agreed on the record that the award was fair and equitable, one of them appealed to vacate the award. The Arbitration Act allowed for three types of review by a trial court after an arbitrator makes a decision: (1) to confirm the award; (2) to vacate the award; or (3) to modify the award. The party did not challenge the arbitration award in the trial court. Therefore there was no right to file an appeal.
